Abstract
Kekerasan dalam rumah tangga (KDRT) di Indonesia mencakup berbagai bentuk kekerasan terhadap perempuan, mengancam kesejahteraan individu dan stabilitas keluarga. Islam sebagai agama rahmatan lil 'alamin menekankan perlindungan perempuan melalui maqasid syariah untuk memastikan hak dan keadilan, serta melindungi dari kekerasan dan ketidakadilan. Penelitian ini mengeksplorasi perlindungan perempuan korban KDRT dari perspektif maqashid syariah, menyoroti kewajiban agama dalam melindungi kesejahteraan mereka. Fokusnya pada pemahaman dan implementasi hukum Islam yang menjamin hak-hak kemanusiaan dan kemaslahatan umat. Penelitian ini menggunakan metode kualitatif studi kepustakaan (library research) untuk menganalisis perlindungan Islam terhadap perempuan korban KDRT dari perspektif maqasid syariah. Mengumpulkan data sekunder dari literatur seperti jurnal ilmiah yang relevan untuk analisis deskriptif. Hasil penelitian ini menunjukkan bahwa perlindungan Islam terhadap perempuan korban KDRT memungkinkan istri mengajukan khulu’ agar dapat melakukan ibadah dengan khusyuk. Menjaga jiwa diterapkan dengan hukum qishas atau takzir terhadap suami yang melakukan kekerasan untuk menjaga martabat dan kesejahteraan istri. Menjaga akal melibatkan pelaporan kekerasan untuk memulihkan mental istri. Menjaga keturunan menekankan pentingnya lingkungan aman bagi anak-anak. Menjaga harta mengharuskan suami memberikan nafkah yang layak, dengan penelantaran atau pengekangan istri tidak boleh bekerja dianggap sebagai kekerasan yang dapat dilaporkan.
Domestic violence (KDRT) in Indonesia includes various forms of violence against women, threatening individual well-being and family stability. Islam as a religion of rahmatan lil 'alamin emphasizes the protection of women through maqasid sharia to ensure rights and justice, as well as protect them from violence and injustice. This research explores the protection of women victims of domestic violence from a maqashid sharia perspective, highlighting religious obligations in protecting their welfare. The focus is on understanding and implementing Islamic law which guarantees human rights and the benefit of the people. This research uses a qualitative library research method to analyze Islamic protection for women victims of domestic violence from a maqasid sharia perspective. Collect secondary data from literature such as relevant scientific journals for descriptive analysis. The results of this research show that Islamic protection for women who are victims of domestic violence allows wives to apply for khulu' so they can perform their worship solemnly. Protecting the soul is implemented by the law of qishas or takzir against husbands who commit violence to maintain the dignity and welfare of their wives. Maintaining sanity involves reporting violence to restore the wife's mental health. Looking after offspring emphasizes the importance of a safe environment for children. Maintaining assets requires the husband to provide adequate maintenance, with neglect or restraint on the wife from working considered as violence that can be reported.
