Abstract
Assunnah adalah sumber hukum yang kedua setelah al-qur’an. Kedudukannya sebagai penjelasan isi kandungan al-qur’an dan sebagai sumber hukum sungguh tidak diragukan lagi, dan kita harus berpegang teguh kepadanya, sebagaimana sabda Rasulullah saw; “aku tinggalkan dua hal sumber hukum penting, jika kalian berpegang teguh kepadanya, maka tidak akan pernah tersesat selama-lamanya”. Kedudukan hukum sunnah tersebut ada yang dihapus dengan sunnah yang kemudian, atau dengan ayat al-qur’an, yang disebut nasakh. Penelitian ini bermaksud mendalami nasakh dalam sunnah dan implikasinya terhadap hukum dan tafsir a-qur’an. Nasakh dalam sunnah adalah penghapusan hukum syari’ah dengan dalil syari’ah yang ada dalam sunnah. Contoh nasakh dalam sunnah adalah kasus nikah mut'ah yang pernah diperbolehkan, tetapi kemudian dilarang oleh Rasulullah SAW. Nasakh memiliki beberapa hikmah, di antaranya: menjaga kemaslahatan hamba, mengembangkan persyaratan hukum, menguji kualitas keimanan, memberikan kemudahan, memastikan realisasi kepentingan hidup manusia dan keadilan dalam pembentukan hukum. Kalau ada yang dihapus, mansukh maka ada yang menghapus, yaitu nasikh, yang menghapuskan, yaitu dalil al-kitab atau as-sunnah yang menghapuskan hukum dalil syar'i atau lafazhnya. Pada hakekatnya naasikh (yang menghapuskan) adalah Allah Azza wa Jalla. Nasakh dalam sunnah tentu meimliki implikasi terhadap hukum dan tafsir al-Qur’an, inilah yang ingin diperjelas dalam penelitian ini.
Assunnah is the second source of law after the Qur'an. Its position as an explanation of the content of the Qur'an and as a source of law is indeed undoubted, and we must adhere to it, as the Prophet (peace and blessings of Allaah be upon him) said; "I leave two important sources of law, if you stick to it, then you will never be lost forever." The legal position of the sunnah was abolished with the later sunnah, which is called nasakh. This research intends to delve into nasakh in the sunnah and its implications for the law and interpretation of the Qur'an. Nasakh in the sunnah is the abolition of sharia law with the postulates of sharia in the sunnah. An example of nasakh in the sunnah is the case of nikah mut'ah which was once allowed, but then prohibited by the Prophet saw. Nasakh has several wisdoms, including: Safeguarding the welfare of servants, Developing legal requirements, Testing the quality of faith, Providing convenience, Ensuring the realization of the interests of human life and justice in the formation of laws. If something is deleted, then there is one who deletes, namely nasikh, who abolishes, namely the postulates of al-kitab or as-sunnah that abolish the law of shari'i or its pronouncements. In essence, the naasikh (who abolishes) is Allah Azza wa Jalla. Nasakh in the sunnah certainly has implications for the law and interpretation of the Qur'an, this is what we want to clarify in this study
