Abstract
Eksistensi Nasakh dalam Implementasi Elastisitas Hukum Islam. Di kalangan ulama ushûl al-fiqh, nasakh merupakan salah satu cara penyelesaian ta`ârudh al-adillah. Namun, di kalangan mereka terjadi perdebatan tentang makna dan eksistensi nasakh dalam nas Alquran dan hadis. Begitu juga pengaruhnya terhadap istinbâth al-hukm. Tulisan ini menjelaskan tentang fungsi nasakh sebagai unsur elastisitas dalam hukum Islam dan pengembangannya. Menurut analisis penulis, dalam rangka pengembangan hukum Islam agar tampak elastisitasnya, maka pengertian nasakh yang tepat adalah pengalihan hukum dari satu tempat ke tempat lain. Selain itu, nasakh juga bisa dimaknai penghapusan sementara, dan bisa diberlakukan lagi ketentuan yang lama jika situasi, kondisi, dan motif yang lama tersebut terulang kembali saat ini.
The Existence of Naskh in Implementing Elasticiy of Islamic Law. In a view of Muslim scholars, naskh (abrogation) is one of the metods in undertaking ta`ârudh al-Adillah. Nevertheles, there are disputes on meaning and existence of naskh in the Qur’an and Hadis and the influence in applying istinbath al-hukm (deducing Islamic law) among them. The present paper is aimed at describing the function of naskh as one of the elsaticity elements in the Islamic law. In developing islamic law, to appear the elasticity, the real meaning of naskh is to abrogate a law from a side to another one. Naskh, on the other hand, also stands for tentative abrogation and it can be applied recently in other way based on apropriate situation, condition, and motivation.
