Abstract

Infertilitas atau kemandulan merupakan salah satu penyebab dari sebab sebab terjadinya konflik rumah tangga yang bisa mengarah menuju perceraian. Penelitian ini menggunakan libary research, yaitu penelitian dengan teknik membaca dan menelaah dan mencatat berbagai literatur atau bahan bacaan dari berbagai referensi seperti kitab-kitab jurnal-jurnal dan referensi-referensi lain dan didukung oleh beberapa sumber data lainnya seperti kitab-kitab perundang-undangan yang memiliki kolerasi dan relevan dengan pokok bahas penelitian. Tujuan penelitian ini adalah menganalisa putusan pengadilan agama Sarolangun yang membahas tentang Perceraian karena Infertilitas dengan melihat putusan tersebut dalam maqhosid al-syariah serta dampak dari penetapan hukum yang telah ditetapkan oleh hakim. Secara umum putusan yang dikeluarkan Pengadilan Agama Sarolangun telah selaras dengan Maqashid Al-Syariah yakni memelihara Agama (Hifzu Al-Din) dan memelihara keturunan (Hifzu Al-Nasl). Adapun secara khusus, berdasarkan pertimbangan-pertimbangan majelis hakim juga selaras dengan tujuan-tujuan Syariat Islam.


Infertility or sterility is one of the causes of the causes of household conflicts that can lead to divorce. This research uses libary research, namely research with reading techniques and examining and recording various literature or reading material from various references such as books, journals and other references and is supported by several other data sources such as books of legislation that have colleration and are relevant to the subject matter of the research. The purpose of this research is to analyze the decision of the Sarolangun religious court which discusses Divorce due to Infertility by looking at the decision in maqhosid al-syariah and the impact of the legal determination that has been made by the judge. In general, the decision issued by the Sarolangun Religious Court has been in line with Maqashid Al-Syariah, namely maintaining Religion (Hifzu Al-Din) and maintaining offspring (Hifzu Al-Nasl). As for specifically, based on the considerations of the panel of judges, it is also in line with the objectives of Islamic Sharia.
